Litigation funding

ECDA partners work together with one of the leading litigation funders, FORIS AG, and have access to a SPV for claims bundling (FORIS CARTEL X).

The principle of litigation financing is straightforward and compelling: In civil and commercial litigation, the litigation funder assumes the financial risk. If the litigation is successful, the funder receives a predetermined share of the profits for their services. In the event of a loss, the funder covers the litigation costs. Additionally, the expenses of out-of-court negotiations can also be financed.

Types of financing:

Main model: absorption of financial risk in exchange for a subsequent share of the revenue

In some cases, it is also possible to combine a partial advance payment with the absorption of financial risk in exchange for a later share of the revenue.

In individual cases, it is also conceivable to use the classic model of purchasing claims.
